Arizona Doctors Reluctant to Perform Illegal Abortions: 'I Have No Intention of Breaking Established Law'

The recent assurances from Arizona Attorney General Kris Mayes that she will not prosecute doctors who defy the state's impending abortion ban are not convincing enough for many healthcare providers to risk performing the procedure, local abortion providers told Axios Phoenix.

Significance:

Arizona is poised to reinstate a nearly total abortion ban dating back to 1864, a move that could make the law enforceable for at least several months despite possible legislative or legal efforts to block it.

Background:

Governor Katie Hobbs has taken measures to prevent county attorneys from prosecuting abortion-related offenses by consolidating prosecutorial authority under the Attorney General’s office. Despite this, Mayes has pledged not to pursue legal action against doctors performing abortions. She recently stated that the old ban might be enforceable by June 8 but vowed to "fight like hell" to prevent that and has discussed with the California Attorney General the possibility of securing emergency licenses for Arizona providers.

However, physicians remain skeptical. Ronald Yunis of Acacia Women's Center expressed his reluctance to Axios Phoenix, noting, "I have no intention to break an established law just because an attorney says they're not going to prosecute." He raised concerns about the possibility of future attorneys general who might choose to enforce the law retroactively.

DeShawn Taylor from Desert Star Institute for Family Planning echoed this caution, acknowledging Mayes' support but emphasizing the need to consider the risks carefully with her board.

Zooming in: The 1864 law states that anyone attempting to induce a miscarriage could face imprisonment. Yunis highlighted fears that even advising a patient to seek abortion services elsewhere could potentially lead to prosecution under the law's broad stipulations.

This complex situation places medical providers in a difficult position, caught between legal risks and their ethical commitment to patient care. Many providers are wary of the potential for future legal changes that could expose them to retroactive prosecution, despite current assurances from the Attorney General. This uncertainty may lead to a conservative approach in providing care, potentially withholding necessary services out of fear of legal repercussions.

Moreover, the ongoing situation illuminates a broader issue of how restrictive laws intersect with medical ethics and patient care. Medical professionals often find themselves at a crossroads where legal frameworks conflict with best medical practices and patient health outcomes. In Arizona, this conflict is exacerbated by the revival of an antiquated law that many view as incompatible with contemporary medical standards and societal norms.

The debate also underscores the varying perspectives within the state, reflecting a broader national conversation about abortion rights. As the situation evolves, the medical community, along with legal experts and advocacy groups, will closely watch how these issues are navigated, potentially setting precedents for other states with similar legislative landscapes.

As Arizona grapples with these legal and ethical challenges, healthcare providers like Yunis and Taylor are making cautious decisions about the services they offer, highlighting the real-world impacts of legal uncertainties on the provision of healthcare. Their experiences emphasize the need for clear, consistent policies that align with modern medical practices and respect for patient rights.
