Two men from Tucson were recently sentenced for their involvement in a tragic incident that led to the death of a 17-year-old migrant in 2022, as announced by the U.S. Attorney’s Office for the District of Arizona.

Gerson Montano, 38, has been sentenced to nearly seven years in prison, followed by five years of supervised release, after being found guilty of migrant transportation resulting in death.

Robert Dale Hart, 64, received a sentence of over four years in prison with an additional five years of supervised release, following his conviction on charges of conspiracy to transport migrants resulting in death.

The sequence of events unfolded on the morning of August 3, 2022, on westbound Interstate 10. When a state trooper attempted to pull over an SUV driven by Montano, he instead stopped in the median. This precipitated a chaotic scene where two individuals were hit by a semi-truck as they and others fled from the vehicle across the highway. The teenage migrant tragically died at the scene, while another person suffered serious injuries and was hospitalized.

The investigation revealed that Hart had hired Montano to transport the undocumented migrants, exposing a deeper smuggling operation. The case was extensively investigated by Homeland Security Investigations, the U.S. Border Patrol, and the Arizona Department of Public Safety.
