Judge Dismisses GOP Lawsuit Against Arizona’s Election Procedures Manual

PHOENIX - A judge has dismissed a lawsuit filed by Republicans aiming to invalidate Arizona’s election procedures manual, dealing a blow to one of three challenges against the state’s election guidelines.

In a ruling released Tuesday, a Maricopa County Superior Court judge dismissed the lawsuit filed by the Republican National Committee, the Republican Party of Arizona, and the Yavapai County Republican Party. The lawsuit alleged that the period for public comment on the manual was too short and sought to block enforcement of certain portions of the manual.

The court concluded that Democratic Secretary of State Adrian Fontes, who authored the manual as the state’s chief election officer and was targeted in the lawsuit, had complied with Arizona’s notice-and-comment requirements.

The Republican National Committee and the Republican Party of Arizona did not immediately respond to requests for comment on the dismissal.

In a statement, Fontes’ office defended the manual: "We used this manual to effectively run the presidential preference election in March and will continue using the EPM to ensure fair elections in the upcoming primary and general elections."

Two other lawsuits challenging the manual remain active in Maricopa County Superior Court.

One lawsuit, filed by the Arizona Free Enterprise Club, focuses on the manual’s instructions regarding the operation of ballot drop-off locations and measures to prevent voter intimidation.

Another lawsuit, brought by Arizona Senate President Warren Petersen and House Speaker Ben Toma, both Republicans, alleges that parts of the manual conflict with state law.
