This practice, known as racial profiling, violates the legal principle that jurors cannot be excluded based on race, ethnicity, gender, or sexuality. The current Alameda County District Attorney, Pamela Price, acknowledged the severity of this misconduct, stating that such actions result in wrongful convictions.

Federal Judge’s Intervention

Federal Judge Vince Chhabria, upon learning about the biased jury notes, recognized a broader issue within the Alameda County DA’s office. He identified a pattern of serious misconduct spanning several decades, involving the automatic exclusion of Jewish and African American jurors from death penalty cases. As a result, he ordered a review of 35 cases from the mid-1980s through 2007, which includes convictions of mass shooters, serial killers, rapists, and murderers.
