Prosecutor blasts Trump co-defendant's 'garbage argument' at heated hearing in classified documents case

FORT PIERCE, Fla. — During a heated court session on Wednesday, a federal prosecutor forcefully countered claims of vindictive prosecution and misconduct made by one of former President Donald Trump's co-defendants in the classified documents case. Prosecutor David Harbach characterized some of the accusations as "garbage" and "a fantasy."

“That was difficult to sit through,” Harbach remarked after attorney Stanley Woodward argued before U.S. District Judge Aileen Cannon that his client, Walt Nauta, was indicted in retaliation for not cooperating with the government.

"It's a garbage argument, to begin with," Harbach responded, rejecting Woodward's claims that another prosecutor from special counsel Jack Smith's team had improperly pressured Woodward by mentioning his application for a judgeship in Washington, D.C., during a meeting.

Allegations of Misconduct

Woodward alleged that prosecutor Jay Bratt implied during the meeting that Nauta’s refusal to cooperate could harm his case. Harbach, who was not present at the meeting, dismissed these allegations as “fragmentary” and “out of context.”

“Mr. Woodward’s story about what happened is a fantasy,” Harbach insisted. “It did not happen,” he added, noting that even if it did, it wouldn’t constitute vindictive prosecution. Amid the intense exchange, Judge Cannon advised Harbach to remain calm.

Woodward stood by his account, stating, “Those things happened. I understood at the time that Mr. Nauta’s refusal to cooperate could be used against him.” He expressed his willingness to testify under oath regarding the meeting. Bratt, who was present in the courtroom, did not speak during the hearing.

Motion to Dismiss Charges

In a separate session later in the day, Judge Cannon reviewed a motion by Nauta to dismiss charges against Trump, Nauta, and Carlos De Oliveira, a property manager at Mar-a-Lago. The motion cited procedural errors in the indictment process. Judge Cannon did not issue a ruling on either motion during the hearings.

Indefinite Trial Postponement

Initially slated to start on Monday, the trial has been postponed indefinitely by Judge Cannon, who cited numerous unresolved legal issues, including the motions to dismiss.
