Brett Favre is asking an appeals court to reinstate his defamation lawsuit against Shannon Sharpe

NEW ORLEANS — Brett Favre, the retired NFL quarterback, is preparing to present his case before the 5th U.S. Circuit Court of Appeals on Tuesday in an effort to revive a defamation lawsuit against Shannon Sharpe, a fellow football icon and former tight end. This legal battle unfolds against the backdrop of a significant Mississippi welfare scandal, which has become one of the state’s most notable cases of public corruption.

The lawsuit stems from comments made by Sharpe during a September 2022 broadcast of the Fox Sports show “Skip and Shannon: Undisputed.” On the program, Sharpe strongly criticized Favre’s involvement in a controversy surrounding the misappropriation of Mississippi welfare funds. Sharpe alleged that Favre had improperly received funds intended for the state’s most vulnerable residents, accusing him of “taking from the underserved” and claiming he had “stolen money from people who really needed it.”

The scandal centers on the Mississippi Department of Human Services’ mishandling of more than $77 million from the Temporary Assistance for Needy Families (TANF) program between 2016 and 2019. State auditor Shad White revealed that Favre received $1.1 million in speaking fees from a nonprofit organization that misused TANF funds, purportedly to finance a $5 million volleyball arena at The University of Southern Mississippi, where Favre’s daughter was involved.

In response to these allegations, Favre promptly reimbursed the $1.1 million. However, he still faces a remaining debt of $729,790 due to accrued interest. Despite these financial transactions, Favre maintains his innocence and has not been criminally charged. Nevertheless, he is among numerous individuals and entities targeted in lawsuits brought by the Mississippi Department of Human Services concerning the misallocation of welfare funds.

U.S. District Judge Keith Starrett dismissed Favre’s defamation lawsuit against Sharpe in October, citing protections under the First Amendment for free speech. Starrett characterized Sharpe’s comments as “rhetorical hyperbole,” asserting that no reasonable listener would interpret them as factual allegations of criminal conduct by Favre.

Favre’s legal team vigorously disputes this characterization, arguing that Sharpe’s statements were perceived by the public as factual assertions rather than expressions of opinion.
