Karen Read set to stand trial again in January in boyfriend's death

A new trial date has been established for January 27, 2025, following a mistrial declared this summer in the high-profile case involving Karen Read, a Massachusetts woman accused of being implicated in the 2022 death of her police officer boyfriend, John O’Keefe. Read, a 44-year-old financial analyst, appeared in court on Monday, marking her first appearance since the judge's declaration of a mistrial earlier this month. This mistrial was declared after the jury, following a protracted nine-week trial held in a courthouse outside Boston, was unable to reach a unanimous verdict despite five days of deliberations.

The prosecution has charged Read with second-degree murder, alleging that she was involved in a violent confrontation with O’Keefe, who had been her boyfriend. The prosecutors assert that Read deliberately backed her Lexus SUV into O’Keefe and subsequently left him to die in the snow on January 29, 2022, in a Boston suburb. This narrative of deliberate malice is central to the prosecution’s case, portraying the incident as a premeditated act of violence.

In stark contrast, Read's defense team argues that the death of O’Keefe was the result of a deliberate cover-up by law enforcement officers. They contend that the investigation was deeply flawed, tainted by procedural errors, biases, and misconduct. The defense accuses the investigators of bias and mishandling evidence, suggesting that the case against Read is built on an unreliable investigation driven by prejudiced individuals.

Attorney Alan Jackson, who represents Read, has vocally criticized the prosecution’s approach. He asserts that the prosecution's case is based on tainted evidence and compromised investigative practices. “We will not stop fighting,” Jackson emphasized, reflecting the defense team’s commitment to vigorously contest the charges.

In addition to the charge of second-degree murder, Read faces accusations of motor vehicle manslaughter while driving under the influence, as well as leaving the scene of a collision resulting in death. Her defense team has filed a motion to dismiss two of these charges—second-degree murder and leaving the scene of a deadly accident—arguing that the jury had reached a consensus to acquit her of these counts. They assert that continuing to prosecute these charges is legally inappropriate based on the jury’s deliberations and the evidence presented.

The prosecution has opposed this motion to dismiss, labeling it as “legally inappropriate” and arguing that it relies on conjecture and hearsay. The judge has yet to make a ruling on this motion, which will be pivotal in shaping the future course of the case.

In addition to scheduling the new trial date, Judge Beverly Cannone has set a hearing for August 9, 2024, to address the motion to dismiss, as well as a trial conference for January 14, 2025. These proceedings will further influence the case's trajectory and address ongoing legal arguments.

John O’Keefe, 46, had been a Boston police officer for 16 years at the time of his death. His body was found unresponsive and was later pronounced dead at the scene. The medical examiner’s report indicated that the causes of death were blunt force trauma to the head and hypothermia.

Read maintains that she dropped O’Keefe off at a gathering and did not see him again until the following morning when she found his body on the lawn of a fellow law enforcement officer. This version of events is central to her defense, which claims that she has been wrongfully framed by police officers aiming to obscure the truth about O’Keefe’s death.

The defense has also alleged significant misconduct by the lead investigator in the case, Massachusetts State Trooper Michael Proctor. They claim Proctor manipulated evidence, failed to conduct a thorough investigation, and sent derogatory and vulgar messages about Read to various contacts, including friends, family, and supervisors. Proctor was suspended without pay earlier this month following these revelations.

Despite his suspension, Proctor has testified that while he did make derogatory comments about Read, he denied that these comments influenced his impartiality or the fairness of the investigation.
