Killing of 6-year-old Hind Rajab in Gaza may constitute a war crime, experts say

On Friday, the experts issued a news release that included forensic analysis showing that the vehicle in which Hind was trapped had been fired upon “from very close range” with weaponry identified as being exclusively used by Israeli forces. This forensic evidence has intensified their concerns about the nature of the incident.

In response to an inquiry from NBC News regarding the allegations and the investigative measures taken by the Israel Defense Forces (IDF), the IDF stated that the incident is "under review" but did not provide further details on the investigation’s scope or progress.

According to the experts, the family members were “shot dead while fleeing,” an act they allege is indicative of a “broader pattern of indiscriminate killings of civilians attempting to find shelter and escape the fighting in Gaza.” This assertion points to a recurring issue of civilian casualties amidst the conflict.

Immediately following the incident, the IDF claimed that its troops were not present in the area where Hind was killed. The experts have rejected this claim as “unacceptable” in light of forensic evidence indicating that Israeli munitions were used against the vehicle.

Hind and her family had sought refuge in their car after receiving evacuation orders from the IDF, which were communicated in Arabic. As they attempted to escape their neighborhood in Gaza City, the experts allege they were “shot dead,” leaving Hind as the sole survivor, trapped in the backseat among the bodies of her aunt, uncle, and four young cousins.

For hours, Hind communicated with emergency services and her mother, pleading for rescue. It was only twelve days later, when the area became accessible to rescuers, that her lifeless body was discovered in the car, situated less than 50 meters from a charred ambulance containing the remains of the two paramedics who had been sent to help.

Hind's 15-year-old cousin, Layan Hamada, who survived the initial attack, made distress calls to emergency services as tanks approached. The line was cut abruptly amid gunfire, and when contact was reestablished, Hind confirmed that Layan was dead.

The experts’ statement criticized the “recklessness” of the military campaign in Gaza, though they acknowledged that their findings and recommendations lack legal authority. Critics of the Israeli military’s track record on prosecuting misconduct highlight data from the Israeli rights group Yesh Din, revealing that between 2017 and 2021, less than 1% of soldiers were indicted out of 1,260 cases of alleged offenses against Palestinians. This data aligns with longstanding accusations of impunity within the IDF’s investigation processes.

According to Gaza health authorities, the ongoing conflict has resulted in at least 39,000 deaths, including approximately 8,000 children. These figures underscore the severe humanitarian crisis in the region, although the data does not specify the breakdown between civilians and combatants.
