Michigan has enacted a groundbreaking piece of legislation prohibiting the use of the so-called "gay and trans panic" defense—a controversial legal tactic that historically allowed defendants to justify violent acts by citing a victim’s sexual orientation or gender identity. House Bill 4718 introduces stringent measures that bar the use of an individual’s “actual or perceived sex, gender identity, gender expression, or sexual orientation” as admissible evidence in criminal trials. The bill specifically prohibits such evidence from being used to establish “reasonable provocation,” claim that an act was committed in a “heat of passion,” or support a defense of “reduced mental capacity.” This legislative move is both a legal and symbolic effort to protect LGBTQ+ individuals from being unjustly victimized through discriminatory legal arguments.
Governor Whitmer’s office emphasized that this new law "significantly expands" protections for LGBTQ+ individuals by shielding them from violence motivated by discrimination, prejudice, and hate crimes. By passing this legislation, Michigan joins an increasing number of states that are actively addressing and curbing discriminatory legal defenses.
National Context and Historical Applications of the Panic Defense
According to the Movement Advancement Project, a prominent LGBTQ+ advocacy organization, Michigan becomes the 20th state to outlaw the gay and trans panic defense. This legislative advancement is part of a broader trend, with federal efforts also targeting the issue. Last year, Rep. Chris Pappas (D-N.H.) and Sen. Edward Markey (D-Mass.) reintroduced the LGBTQ+ Panic Defense Prohibition Act, aiming to ban such defenses in federal courts.
One of the most notable cases involving the gay panic defense was the 1998 trial of Aaron McKinney, who, along with a co-defendant, was charged with the brutal murder of 21-year-old Matthew Shepard in Wyoming. Despite attempts to use the panic defense, it was ultimately rejected, and both defendants received life sentences.
Nevertheless, the gay panic defense has seen varying degrees of success in other cases. For instance, in 2018, James Miller of Texas was given a relatively light sentence after fatally stabbing his neighbor, Daniel Spencer, who allegedly made an unwanted advance. Similarly, in 2009, Joseph Biedermann was acquitted of murder for the death of Terrance Hauser, whom he admitted to stabbing over 60 times, claiming Hauser had threatened him with sexual assault.

House Bill 4718 was introduced by state Representative Laurie Pohutsky, a bisexual legislator and advocate for LGBTQ+ rights. The bill narrowly passed the state House with a 56-54 vote last month. Pohutsky has underscored the importance of the bill amid rising anti-LGBTQ+ violence, particularly targeting transgender individuals. In September 2023, she referenced data from the Equality Michigan Action Network, highlighting that Michigan is among the top 10 states with the highest usage of the panic defense.

Emme Zanotti, Director of Advocacy and Civic Engagement at Equality Michigan, voiced strong support for the legislation. In a statement shared with NBC News, Zanotti emphasized that LGBTQ+ individuals "deserve the same protections as everyone else." She praised Representative Pohutsky’s bill as a crucial step in rectifying past wrongs and advancing a more united and inclusive state. Zanotti highlighted that banning the LGBTQ+ panic defense ensures there will be "no more free passes for violent crimes against our community members."
